In a major judicial intervention that underscores the gravity of crimes committed by those in power, the Supreme Court of India today, Monday, December 29, 2025, stayed the release of former BJP MLA Kuldeep Singh Sengar, effectively halting the Delhi High Court's recent decision to suspend his life sentence.

Presiding over a vacation bench, Chief Justice of India Surya Kant, alongside Justices J.K. Maheshwari and Augustine George Masih, delivered a firm message that the legal technicalities regarding Sengar’s status as a "public servant" must not lead to a miscarriage of justice or grant undue immunity to lawmakers. 

The Bench expressed deep concern over the High Court’s interpretation of the POCSO Act, noting that if an MLA is not considered a public servant, it would create a dangerous loophole where high-ranking officials face less accountability than a common constable. By ruling that Sengar "shall not be released," the apex court prioritized the safety of the Unnao rape survivor and her family, acknowledging the CBI’s warning that Sengar’s immense political influence and "muscle power" pose a lingering threat.
