Ahmedabad court directs Congress to remove deepfake video featuring PM Modi, Adani

A civil court in Ahmedabad has directed the Indian National Congress and its four leaders to remove a deepfake video featuring Prime Minister Narendra Modi and Industrialist Gautam Adani from its all social media platforms including X within 48 hours of the order.

A civil court in Ahmedabad has directed the Indian National Congress and its four leaders to remove a deepfake video featuring Prime Minister Narendra Modi and Industrialist Gautam Adani from its all social media platforms including X within 48 hours of the order.

In a suit filed by Adani Enterprise Limited, the Additional Civil Judge Shrikant Sharma granted ad-interim relief and asked Congress leaders Jairam Ramesh, Supriya Shrinate, Pawan Bhanu Chib to remove the deepfake video from all its social media platforms. The video was posted by Congress on social platforms on December 17.

The court has also directed social media platform X and Google to take down the impugned video within 72 hours, in case respondent fails to take down the video within 48 hours of the order.

The social media platform X and Google are also named as defendants in the case.

In the event of non-compliance of direction by the defendants granted, the court has kept it open for the plaintiff to approach the concerned intermediary in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 for appropriate takedown action.

The suit filed by plaintiff Adani Enterprise Limited said that, video sought to portray him as a ‘white-collar criminal’, ‘land mafia’, ‘politically connected offender’ and a person indulging in abuse of power. The plaintiff submits that such expressions are per se defamatory and have been circulated to the general public without any factual basis.

The impugned content is not only defamatory but also violative of his fundamental right to reputation under Article 21 of the Constitution of India.

The plaintiff states that he has never been involved in any criminal activity or wrongdoing, nor has any competent authority found him liable for any of the allegations broadcasted by the defendant.

The plaintiff is a diversified group in India comprising 10 publicly traded companies and has pan India presence in transport logistics and energy utility portfolio businesses across the country.

Consequently, any defamatory content or negative posts published on social media platforms targeting the plaintiff are likely to tarnish their reputation, undermine their goodwill, and cause significant harm to their public image in the eyes of society at large.

The court has issued notice to the defendants returnable on December 29.
