On 28 July,Tuesday the Supreme Court directed all state governments to release all student protesters who are minors and have no criminal records.
The 3 judge bench presided over by CJI Surya Kant stated that there cannot be an allegation of excessive violation merely because it is an agitation.They also stated that interim protection would not be provided to those who threw anti-Social sentiments and who has criminal records antecedents.Peaceful protests are permitted under the Constitution of India and peaceful protest are sometimes hijacked by some “uninvited guests with agenda” so why should there not be an independent probe into all of his? SC ensures to set up a high powered committee for systematic investigation into this matter for Centre and for states too.
The court directed preservation of CCTV footage, drone recordings, body-worn cameras footage,wireless communication records and PCR calls relating to the protests. Police are also ordered to preserve data of protesters however not to release any personal information in public domain.
The matter now will be heard on Monday when the Centre and the states are expected to place their responses on record.
