Its a moral victory for Samarjitsinh Gaekwad after the Charity Commissioner observed him as the elected member of the Baroda Cricket Association. Samarjitsinh was removed as a President of Baroda Cricket Association by the present Managing committee on 17th July during the 77th AGM of the Baroda Cricket Association. The observation and order by the court is in the matter where the the three member filed a application for the BCA elections.
Represnting Royal group the president Samarjitsinh Gaekwad was removed as president of the BCA after the managing committee passed a no confidence motion against him. Jitendra Patel was appointed as the new president of the association who was earlier the Vice President of the BCA.
Samarjitsinh Gaekwad was replaced as President in the 77th Annual General Meeting (AGM) of Baroda Cricket Association (BCA) and the Vice President Jitendra (Pop) Patel was chaired the meeting and passed the 2013-14 accounts and Auditor of 2014-15. The decision was taken after Samarjit Gaekwad left the house saying it as concluded but the members continued the meeting and passed the points.
“It was a very important observation and order by the court as the present managing committee removed me as a President illegaly and against the Act of Baroda Cricket Association. That was a cowardly act and they are doing this because a senior committee members wants to take revenge from me. The present committee is misguiding the members and they don’t have any idea of the law. This is a preliminary finding and more will come later on,” said Samarjitsinh Gaekwad.
Samarjitsinh also said that the present committee is responsible for the inappropriate use of money of the association and also for the poor state of Ranji team. “The members are running the association as per their terms and misguide everyone. The removal of Sanjay Patel and after I concluded the meeting they remove me as a President of the BCA which is against the law of the association. They are using the association money for all these legal proceedings which is wrong as they should have use the money from their own pocket. The position of the Ranji team is all time low in their tenure and I can’t see such a condition of a cricket team since I represent the association. This is just a start and I want to bring everything in front of everyone,” said Gaekwad.
The matter was that a three members give an application and asked for direction at the Charity Commissioner regarding elections of the BCA which is due as the two year term is already over as per the law. The last election was held in 2013 and the two year term ends on 2015. The application was to declare elections and for that they made opponent as the BCA and second one Samarjitsinh Gaekwad as President of BCA. Amar Petiwale present before the court as BCA Secretary as also Samarjitsinh Gaekwad with his lawyer.
Petiwale argued and said Samarjitsinh Gaekwad was removed as the President of BCA and now the court has to order who will represent the BCA. Then the court observed and order that Samarjitsinh Gaekwad is the elected President of BCA and Amar Petiwale is the selected secretary of BCA. So as per Society Registration act and Trust Act the elected person will represent the BCA and Amar Petiwale petition is rejected. The hearing is still to happen in the petition but the Charity Commissioner observe Samarjitsinh Gaekwad as the President of the BCA and the elected post of Secretary as Vacant in the BCA as observe by the Charity Commissioner.
